Chairman Ginter called the regular meeting of the Transportation & Circulation Commission to order at 4:00 p.m.
Commissioner Hardwick made a motion to approve the minutes of August 6, 2001. Commissioner French seconded, and the motion passed unanimously.
Gene Viramontes, Street Superintendent, Maintenance Services Department, City of Fullerton stated that this recommendation was to include additional streets in the Richman Park area with the posted daytime sweeping program. The City Council asked this area to be reviewed and to add a second day of street sweeping. Currently, the area is swept every Friday between the hours of 8:00 a.m. and noon but the streets are still not clean enough. The Maintenance Services Department recommended adding Tuesday to the street sweeping for this area and adding new signs reading Mondays, Tuesdays, & Fridays between 8:00 a.m. and noon.
Mr. Viramontes stated that the negative aspect of this added day would bring the loss of parking on Tuesdays and Fridays for four hours. Citations will be issued to parking violators on both sweeping days; signs would be placed at every corner and approximately 150-foot intervals. The signs would be posted so that it is easily recognizable. The positive aspect is that more frequent sweeping keeps inoperative vehicles from accumulating on the street, which is an existing problem. We will have cleaner streets and gutters, and overall improved appearance in the public property. Mr. Viramontes hopes that it will eliminate the unsanitary and unhealthy conditions such as diapers, trash, auto parts, and paper trash from vendors. Mr. Viramontes wanted to add Richman Avenue between Valencia Avenue and West Avenue to this request.
Commissioner Hardwick had asked Mr. Viramontes if the residents had originated this request.
Mr. Viramontes stated that the surrounding community reported seeing lots of trash and they did not like seeing that.
Commissioner French asked if this area was in a special clean up mode that the City was sponsoring.
Mr. Viramontes stated that the City has a NET Team through the community redevelopment. They are possibly removing some buildings, opening up the area, reconfiguring the streets, and allowing parking only off street and not overnight parking.
Commissioner Buck asked how many streets in the City are swept more than once a week and how many people attended the community meeting. Commissioner Buck also asked if Maintenance Services Department was responsible for determining where the signs go.
Mr. Viramontes stated that Harbor Boulevard is the only street swept twice a week. This would be the second area that would have twice a week sweeping. Approximately 50-60 people attended the meeting. All the attendees supported this idea. Mr. Viramontes stated that the sign placement is determined by Mark Miller and Dave Langstaff.
Commissioner Robeson asked how much late night sweeping does the City do.
Mr. Viramontes stated that the City does not do any late night sweeping but they do early morning as early as 4:30 a.m. and 5:00 a.m. but the majority of the sweeping is done from 6:00 a.m. to 3:00 p.m.
Chairman Ginter stated that West Avenue is a high-density street for on-street parking and there is no present signage on West Ford Avenue and Elm Avenue. Chairman Ginter asked if there was some provision for initial citation warnings before we get into violations and fines because this will be a surprise for many of the residents.
Lieutenant Mayes stated that the Police Department would be doing a three week courtesy citation as the program is implemented and on the forth week, citations will be given.
Commissioner Cochran asked if the blue curb area was being swept.
Mr. Viramontes stated that area is included in the regular daytime sweeping program but there are no parking restrictions.
Commissioner Robeson asked what the rationale was behind not sweeping at night especially in the downtown business district.
Mr. Viramontes stated that sweeping was done at night until the mid 80's but the City was having problems with the machinery and employees. The City had better control once it was put to daytime sweeping and the program could be managed more efficiently during the day than at night. The majority of the people who are employed leave during the day to go to their jobs. This leaves a lot of the curb open during the day than it would at night. Even though there is a 2:00 a.m. to 5:00 a.m. no parking ordinance, lot of cars were being parked on the street during that time and it was very cumbersome for the Police Department to go out there and give citations.
Mr. Viramontes stated that there are areas such as the Fullerton College that has this program in place. The City selected problem areas. On Monday and Thursday, the City sweeps Harbor Boulevard and that includes the side streets one block on either side of Harbor Boulevard in the downtown area.
Commissioner Francis asked if every street is swept in Fullerton and if we were doing something extra by adding this request to the street sweeping program.
Mr. Viramontes stated that all of the streets in Fullerton are swept once a week. This program gives the City the opportunity to prohibit parking in those areas that are high density and multiple vehicles parked on the street. Prior to this program in the Richman Park area, there was no way to sweep the curb because of the cars parked.
Chairman Ginter recommended that when and if this item goes to City Council, the economic impact might want to be addressed whether it is negligible or significant.

City Traffic Engineer Mark Miller presented the request to remove the overnight parking restriction on Wilshire Avenue between Jefferson Avenue and Woods Avenue. Staff received a petition from Mrs. Jan Cogan, 711 Wilshire Avenue requesting the exemption from the 2:00 a.m. to 5:00 a.m. parking prohibition. Wilshire Avenue is a 36-foot wide east/west residential street; on-street parking is permitted on both sides with the exception of overnight parking restriction. Wilshire Avenue is comprised of 8 single-family properties on the north side and 10 single-family properties on the south side with no accident history for the past 12 months. According to the Section 844080 Municipal Code it provides for overnight parking exemptions. It states that a majority of the property owners on both sides of the street must be in favor of the exemption and may be granted for an area of having an off-street parking deficiency. The smallest area that may be accepted is one city block on either one side or both sides and the procedure that was adopted by the City Council in December 1993 defines a parking deficiency as not meeting current minimum parking requirements for the same type of land use. A single-family property, the minimum off-street parking requirement is two-car garage. Although the petition met the minimum requirements regarding the required signatures and the percentages, the makeup of the neighborhood require that staff address individual zone areas.
Zone 1, 60% of the property owners on the south side of Wilshire Avenue signed the petition satisfying the majority requirements. Staff received a telephone call from one person on this block opposing the petition. Some residents did not sign the petition. All the properties have a two car garage with a driveway of sufficient width and length to park additional vehicles. Staff does not support the removal of the overnight parking in Zone 1 because the properties do not meet the deficient standards.
Zone 2 had 25% percent of the property owners on the north side signed the petition, majority of the properties have a two-car garage with sufficient width and length to park additional cars except for 733 Wilshire Avenue is considered to be parking deficient but the property owner did not sign the petition. Staff does not support the removal of the overnight parking in Zone 2.
Zone 3 100% of the property owners signed the petition on the north side satisfying the majority requirements. Two properties 719 and 715 Wilshire Avenue on the north side are deficient having a one-car garage. Overnight parking is permitted in the north/south alley on north Wilshire Avenue and both sides of Woods Avenue north of Wilshire Avenue.
Zone 4 80% of the property owners signed the petition. Property 708 Wilshire Avenue did not sign the petition, 716 Wilshire Avenue has a carport with a one car driveway access and 712 has a one-carport with no driveway plus one additional uncovered vehicle parking space. Parking is allowed in the alley. Staff recommended allowing overnight parking on the north and south side of Wilshire Avenue between Adams Avenue and Woods Avenue.
Commissioner Robeson asked if overnight parking was allowed west of Jefferson Avenue and east of Woods Avenue.
City Traffic Engineer Mark Miller replied that Woods Avenue north of Wilshire Avenue allows overnight parking but overnight parking is prohibited on Jefferson Avenue and Woods Avenue and an exemption on Drake Avenue.
Commissioner Buck asked if the T-intersection constituted a block.
City Traffic Engineer Mark Miller stated that staff has considered T-intersections before although there is not a street that intersects it, we have to divide it. In this case, staff wanted to know if the residents on the west side of Adams Avenue were interested in an exemption and that is why staff asked the petitioner to extend their petition to Jefferson Avenue.

Jan Cogan, 711 West Wilshire Avenue stated that she originally submitted the petition for Woods Avenue to Adams Avenue and was asked by staff to extend it to Jefferson Avenue. Ms. Cogan circulated the petition in August and a lot of families were on vacation. Once she received 51% signatures, she stopped. Ms. Cogan talked to one resident who was opposed. The real need is between Woods Avenue and Adams Avenue. Ms. Cogan stated that she has two cars and only one car fits in the garage. Her husband comes home at night and if he parks in the alley they would have to move cars and it is very difficult. They take a chance by parking on the street. There was an issue with another resident who went to the Police Department to file a complaint because there were too many cars parked on the street and 600 cars were ticketed. If he had not complained, this probably would not have been an issue for the Commission and they are frustrated and do not have enough parking in our area.
Commissioner Francis reminded Ms. Cogan that if this passes other cars will park in front of her house.
Commissioner Robeson added that in fact we do end up with more problems when we exempt those areas.
Katherine Ingram, 221 Woods Avenue stated that she was lucky enough to have a large driveway to park her cars but most of the time she parks her cars on the street taking the chance of being ticketed. Ms. Ingram did not want her street to look like Wilshire Avenue where it is wall to wall cars; children run out, you could hardly drive through the street because it is so narrow. Ms. Ingram signed the petition because 301 Woods Avenue has two homes on a lot and do not have enough parking. Even though they have open parking on Woods Avenue, there are so many cars parked there that there is not enough parking. There definitely is a parking need and I want it to legal for her to park in front of my house but she did not want anyone else to.
Kay Raugust, 715 West Wilshire Avenue stated that most of the homes that do not have adequate parking are the Spanish style homes. Ms. Raugust stated that she happens to live in the home that has a driveway and does not have a problem with parking but she came for her neighbors. These homes are 75 years old and back in those days people did not have two cars. Ms. Raugust's neighbor has two cars and they barely have a one-car garage. Their driveway is very short. Ms. Raugust grew up in this house and when her parents bought the 49' Ford they had to take the archway out just to get it to the garage.
Hector Delgado 716 West Wilshire Avenue stated that his home has a one-car garage that is a barn style garage and has two mini vans. Mr. Delgado felt unsafe about having his wife parking in the alley and felt that it was safer parking in front of his home.
Kay Raugust stated that she heard that in one area it was illegal to park unless you have a permit and wanted to know if there was a permit that the residents could obtain.
Chairman Ginter replied that the City of Fullerton does not have a permit parking policy parking permit policy that addresses this situation but they do not affect the residential neighborhoods. In July the City Council asked staff to review the ordinance, the definitions, and consider an exception permit process but currently we do not have a permit process.

Commissioner Robeson asked Lieutenant Mayes if there had been any problems in that alley.
Lieutenant Mayes replied that there have not been any problems in that alley.
Commissioner Robeson stated that if this is approved, all the neighbors are going to park there. The streets are not going to get swept. Commissioner Robeson view was that he would not approve overnight parking.
Commissioner French moved to accept staff's recommendation and not approve the removal of the overnight parking restriction in Zones 1 and 2. Commissioner Buck seconded.
The motion passed unanimously.
Commissioner Hardwick stated that he did not like the fact that the residents were knowingly breaking the law. These people have come to us and used the process that we have set up, signed a petition, these people are supportive of their neighbors parking in front of their homes and they need relief.
Chairman Ginter stated that he has consistently voted in favor of allowing the exemption were there is a hardship and he too did not want to force citizens to knowingly break the law so he would vote in favor of allowing the exemption for Zones 3 and 4.
Commissioner Buck stated that he would vote against it because he suspected that if it is approved, the residents would be back in a year or two asking to rescind it because all the neighbors will be parking there, and he does not believe that the City Council would pass this because they have overturned this issue several times in the recent past.
Chairman Ginter stated that staff is recommending that there is a deficiency and the law on the ordinance allows for the exemption in those cases.
Commissioner French stated that she would not support it because she believes that some effort could be put forth perhaps in the alley to make some of it a little more workable such as putting lights up on top of the garages to make it more comfortable to pull in at night.
Chairman Ginter stated that he thought that the concern about other people overloading the parking is scurrilous because we have allowed this variance in many areas in the community and has not heard nothing about too many people are parking in front of my house.
Commissioner Cochran stated that he did not like seeing people have to make a choice between getting a ticket and parking out on the street and some of the homes do not have any choice. The possibility that other people might park there overnight could happen to any of these instances and the Commission has not seen a lot of people rescinding them. Commissioner Cochran stated that he would support staff's recommendation.
Commissioner Hardwick moved to accept staff's recommendation to approve overnight parking in Zones 3 and 4. Commissioner Cochran seconded.

City Traffic Engineer Mark Miller stated that overnight parking proposed permits process was coming back to the Commission in December.
Commissioner Buck requested to notify all the people who were denied in the past six months for overnight parking to be notified.
City Traffic Engineer Mark Miller presented the request for overnight parking exemption on Gregory Avenue between Martha Place and Alberta Place. The petition was received by Mr. Scott Cathorall, property owner at 1658 Gregory Avenue requesting the exemption. Gregory Avenue is a 36-wide street, the prima facie speed of 25 mph, on-street parking is permitted except for the overnight parking restriction, comprised of four single family homes on the north side and six single family homes on the south side, 100% of the property owners on the north side signed the petition and 83% on the south side satisfying majority of the requirements. The properties on the north side do not meet the deficient definition and only one property on the south side (1672 Gregory Avenue) meets the definition of deficient property. This property has a one-car garage but a long driveway. Staff recommended denying the request for overnight parking exemption between Martha Place and Alberta Place.
Chairman Ginter stated that he had a problem with staff's notice of lack of deficiency on the north side because they had very short driveways and did not know if a car parked in the driveway would block the sidewalk if there were sidewalks, and did not think that two cars could be parked in their garages.
City Traffic Engineer Mark Miller stated that these homes had short driveways but had two-car garages. Overnight parking is permitted adjacent to the property on north Alberta Place.

Kevin Carlson, 200 North Florence Place stated that he has a large truck and an Expedition and neither vehicle fits in the garage. His garage is filled with stuff. Mr. Carlson stated that when he parks on his driveway, he blocks the sidewalk. He has no choice and he can park on his lawn or blocking the sidewalk. In our neighborhood we have large families, high school students, workers, children and grandchildren living with their parents and they need parking just as bad as we do. Whether we get ticketed or not we will park there seven days a week. Mr. Carlson asked for the Commission to approve both sides of the street for overnight parking.
Tony Giourgas, 1662 Gregory Avenue stated that the last time that anyone has been ticketed was about eight years ago and everyone has been parking on this street since then and there has never been any problems with other people parking in front of their homes. Mr. Giourgas urged the Commission to pass overnight parking because it has been a problem and there is not enough room to park because the families have teenage kids driving and they are going to be parking in the street because they have no choice. Mr. Carlson recommended for the Commission to consider and approve overnight parking.

City Traffic Engineer Mark Miller stated that staff received a request to remove the overnight parking on West Walnut Avenue between Richman Avenue and Highland Avenue. The request came from Mr. Gene McHugh, business owner of Joseph Webb Foods, 392 West Walnut Avenue. The reason for his request is because he runs a 24-hour a day business and has difficulty in parking his trucks for loading and unloading or a staging area on his property. Walnut Avenue is 71-feet wide, a collector street with a speed limit of 25 mph. Majority of the street allows on-street parking on both sides with the exception of overnight parking. Due to the reconstruction of Highland Avenue undercrossing, a portion of Walnut Avenue on the north and south side has "No Stopping Anytime". The street is comprised of two properties on the south and the Burlington, Northern, and Santa Fe Railroad own the property on the north. The petitioner received support from one of the property owners but the other property owner was difficult to locate and has not responded to repeated written request. A spokesperson from the railroad company indicated their support of the petition provided that there is emergency access to the property still provided and that the trash is cleaned up if the property owner leaves it on the south.
City Traffic Engineer Mark Miller stated that there is a similar situation on Kimberly Avenue between Raymond Avenue and Placentia Avenue. The railroad company owns the property on the north and there are businesses on the south. Overnight parking of trucks is allowed from 2:00 a.m. to 5:00 a.m. here.
Based on the apparent need for the on-street parking between 2:00 a.m. and 5:a.m. and because there is no apparent hardship placed on the adjacent properties or a traffic safety issue. Staff supported the request and recommended to the Commission to approve and allow overnight parking on the north side of West Walnut Avenue between Richman Avenue and approximately 725 feet east of Richman Avenue. The red zone will remain and be used as emergency access to the property.
Lieutenant Greg Mayes asked if there was a 3-hour parking restriction for commercial vehicles currently in place. Allowing overnight parking does not exempt the commercial vehicles from the 3-hour restriction.
Dave Langstaff stated that there was a 3-hour parking restriction in place.
Chairman Ginter clarified that the 3-hour limit is not posted, but it is a City Ordinance for any public street dealing with commercial parking. Chairman Ginter stated that if the Commission approves overnight parking, we would have to rescind the 3-hour limit.
Lieutenant Greg Mayes stated that Kimberly Avenue on occasion has become a home for wayward trailers and tractors that no one has an understanding of where they came from.
City Traffic Engineer Mark Miller stated that Walnut Avenue is going to be reconstructed in two weeks. The City is going to rebuild the street from Highland Avenue to Richman Avenue.
Chairman Ginter clarified that overnight parking would not be allowed on the south side of Walnut Avenue.

Gene McHugh, General Manager of Joseph Webb Foods thanked Dave Langstaff and Teri Carlson for their professionalism and friendliness. Joseph Webb Foods is a chain distribution company that distributes to schools and military. They have about 100 employees and are happy with their facility but do not have the right amount of parking. In the future Joseph Webb Foods would like to lease the vacant lot next door but at this time they will not even talk to them about it. Their second choice would be to park on the street overnight on the north side. The trucks will not be sitting there all night because they will be loading them all night long. The request is not a convenience but a place to park their trucks.
Chairman Ginter asked if their business had a lot of on-site truck parking enclosure.
Gene McHugh stated that they have a gated area parking lot next to the vacant lot. Gene McHugh stated that they made an acquisition with another small competitor. They will incorporate 8 trucks with their business. Joseph Webb Foods anticipates adding another truck or two.
Commissioner Robeson asked if it had been addressed to acquire the vacant lot.
Gene McHugh stated that they had asked the real estate people who have talked to the owner and said that building in an estate. They had it for sale but did not want to do anything until they leased or sold it to let Joseph Webb Foods use the lot because it may interrupt the deal.
Commissioner Robeson asked staff if the City knew who owned the property and how long has the lot been vacant.
Dave Langstaff stated that Fullerton Manufacturing Company owned one lot and the other is held in trust.
Gene McHugh stated that they had been in their building for almost six years and the now vacant lot was occupied briefly when Joseph Webb Foods first moved into their building.
Commissioner Hardwick stated that Gene McHugh's letter says that he was denied a request to park in an open area behind their building.
Gene McHugh stated that the area where they removed the spare railroad tracks behind their building is vacant now. Joseph Webb Foods asked permission to pave it and use until they decide to make a greenbelt out of the land and put it back to a greenbelt.
Commissioner French asked where do the employees park.
Gene McHugh stated that the employees park next to their building on the south side of Walnut Avenue.

Commissioner Francis moved approve the request to allow overnight parking on the north side of Walnut Avenue between Richman Avenue approximately 725 feet east of Richman Avenue and rescinding any restrictions such as the 3 hour limit. Commissioner Robeson seconded. The motion passed unanimously.
City Traffic Engineer Mark Miller presented the request to rescind the exemption of the overnight parking restriction on Mountain View Place between Sudene Avenue and Commonwealth Avenue. A petition was received from Mr. Michael Arneson, property owner of 113 South Mountain View Place requesting that the exemption from 2:00 a.m. to 5:00 a.m. be reinstated on Mountain View Place. In September of 2000, the Commission approved the request to remove the overnight parking restriction. The same residents are now requesting the overnight parking restrictions be reinstated. Staff recommends to the Commission to approve the request to rescind the exemption and reinstate the overnight parking restriction on the east side of Mountain View between Sudene Avenue and Commonwealth Avenue.

Rosanne, 2000 East Commonwealth Avenue stated that she originally submitted the first petition to remove the overnight parking restrictions due to inadequate parking for her fourplex. In her fourplex, three quarters of the residents are families with two cars per household. Rosanne spoke to some of the residents who signed Mr. Arneson's petition and stated that those residents were under the impression that they were signing for a neighborhood watch and not to rescind their parking privileges.
Commissioner French asked Rosanne if they had garages and confirmed that she had 8 vehicles.
Rosanne stated that they have garages but only one vehicle could fit in the garage at one time. She had tested all her different vehicles and only one vehicle could fit in the garage. Rosanne stated that there is not enough parking because her fourplex is on the end of the street, she had the neighbors authorization and she explained the situation to them and asked if there was ever a problem to come to her because she is the representative for that fourplex and she would address the issue and take care of it. All the families in her complex are fixed income families and can not afford parking tickets. Her fourplex lost two families because they could not afford the parking tickets. Rosanne stated that there is only enough parking for 4 to 5 vehicles on the east side of Mountain View Place so the two areas that were exempted by the Commission the last time is not a big issue of cars making a big mess.
Betty Lundgrene, resident on Sudene Avenue stated when she moved in to her home in 1959, there was never a parking problem. It is up to the landlord to judge who you rent to and not to rent to someone who has two gigantic trucks and extra cars. Betty Lundgrene stated that she was against the overnight parking because it makes our streets look like Anaheim.
Ralph Higgins, 101 South Mountain View Place felt that the fourplex's address is Commonwealth Avenue so they should park on Commonwealth Avenue without overnight parking.

Commissioner Hardwick moved to accept staff recommendation to rescind the overnight parking; Commissioner French seconded.
Chairman Ginter stated that he was inclined to keep the exemption because as always there appears to be hardship at 2000 Commonwealth Avenue, the people who signed the petition are all on the opposite side of the street with the exception of 2001 Sudene Avenue. Therefore he would vote against staff's recommendation and keep the parking exemption on the east side of Mountain View Place.

The motion passed with a 4 to 3 vote to rescind the overnight parking on Mountain View Place.
City Traffic Engineer Mark Miller presented the request. Ms. Lisa Marquez, Operations Department for Hope International requested that the City install a portion of yellow curb on the south side of College Place within the cul-de-sac. The request was made because of the construction taking place on Titan Drive and the street is closed off and they do not have anywhere to load and unload their goods for the University. Staff believes that this action would not result in any additional hardship for the residents or the students within the area. Staff recommended to the Commission to approve the request to install the yellow curb 20-minute loading/unloading on the south side of College Place, which amounts to 50 feet.
Chairman Ginter asked if this was a temporary request due to the construction.
City Traffic Engineer Mark Miller stated that it would be permanent because Titan Drive is going to be vacated.
Commissioner Buck stated that a bunch of two-hour parking spaces were lost plus a lot of parking was lost from the University because of the apartments that are being built.
Chairman Ginter stated that the south side of College Place shows overnight parking exempted but he was unable to find any signage indicated that overnight parking is allowed.
Dave Langstaff stated that it has been approved but maybe the sign was knocked down.

Charles Lawry, Assistant President of Hope University stated that this request is for the trucks to back into the yellow spot. The truck would not be parked parallel but they would come in and back up and there is a sidewalk just to the west of the yellow and then the driver would wheel his goods north to the cafeteria. One of the problems that they are facing now is that cars park on the curve making it difficult for the trucks to unload and maneuver the trucks around with the cars parked there. This issue is mainly to free the curve of cars so that the trucks can manipulate the curve.
Commissioner Hardwick had asked Lieutenant Mayes if there was a restriction about a cul-de-sac or curved end when you can not nose in would you have to park parallel to the curve or are commercial vehicles exempt.
Lieutenant Mayes stated that the maneuver that was described is illegal. Lieutenant Mayes stated that making the curb yellow until the driveway would avoid cars parking there and give some relief for the large trucks to back in but the nose of the truck sticking out in the street is a hazard for cars making a u-turn in the cul-de-sac.
Dave Langstaff stated that the request for yellow curb was not specific on the length and staff is open to increase the length of yellow curb to the driveway.
Commissioner Robeson asked if the University has more than one truck at a time.
Charles Lawry replied that they have one truck at a time.
Commissioner Robeson stated that it would be advantageous and legal for the trucks to park if the curb is painted yellow to the driveway.
Chairman Ginter asked if Titan Drive being vacated effected any of this because there would not be through traffic from Titan Drive to College Place making it a dead-end alleyway. Chairman Ginter asked if this would allow the trucks to back in and suggested extending the yellow curb to the driveway.
City Traffic Engineer Mark Miller stated that the trucks enter/exit College Place make u-turns and park on the street.

Commissioner Robeson moved to approve staff's recommendation to install yellow curb and extending it to the driveway (approximately 75 feet). Commissioner Hardwick seconded.

City Traffic Engineer Mark Miller presented the request from Ms. Delgado, Customer Service Manager, U.S. Post Office to install 50 feet of green curb and 30 feet of red curb in front of the 1920 West Commonwealth Avenue, Post Office. This request was made in effort to improve traffic congestion within their parking lot to provide easier access to the mailboxes and future FEX mailboxes that will be installed. Vehicles from the adjacent apartment complex to the west currently park their vehicles in front of the post office for extended periods and prohibits customers from pulling to the curb to utilize the existing mailboxes on the street and requiring the motorist to park in the post office parking lot. In addition, trucks will occasionally park in this location and results in reduced sight visibility for vehicles exiting the post office driveway. The request for 50 feet of green curb (15-minute parking) only applies between the hours of 6:00 a.m. and 6:00 p.m. Monday through Saturday (Sundays and holidays exempt), and 15 feet of red curb on each end of the green curb to increase sight visibility for drivers entering and exiting the post office driveway.
Staff recommended approving the installation of 50 feet of green curb and 15 feet of red curb on each end of the green curb to prohibit the parking.
Commissioner Ginter asked if it was necessary to install 15 feet of red curb on the west exit if a car is exiting.
Dave Langstaff stated that there may already be red curb and that may be to repaint it.
City Traffic Engineer Mark Miller stated that Traffic Engineering could install up to 40 feet without bringing it before the Commission.

Commissioner Buck moved to accept staff's recommendation to install 50 feet of 15-minute green curb and two segments of 15 feet of red curb. Commissioner Robeson seconded. The motion passed unanimously.
City Traffic Engineer Mark Miller stated that a request was received to revise the existing parking prohibition on the north side of Santa Fe Avenue from 142 feet east of Lemon Street to 358 feet east of Lemon Street. Staff received a letter from the Orange County Transportation Authority (OCTA) to request a revision to the existing parking restriction on the north side of Santa Fe Avenue directly behind the Fullerton Fire Department at 312 East Commonwealth Avenue. Due to OCTA's increase in the frequency of their bus service to the Transportation Center and in order to relieve congestion in the Transportation Center as a result of their increase service, the OCTA is requesting longer periods of time for buses to stage on Santa Fe Avenue.
In 1999, the City installed a prohibition from 6:00 a.m. to 8:00 a.m. and from 4:00 p.m. to 6:00 p.m. Monday through Friday. The sign is posting "No Parking" buses exempt. OCTA is not requesting that posting to read "No Parking Anytime" buses exempt. Staff did a parking utilization study and determined that the area is impacted several times a day, sometimes a vehicle is parked and not moved during the times that they need to be moved. Staff had discussions with the Fire Department and they agreed that the removal of the parking behind their station would not impact them.
Staff believes that this request would not create an additional hardship in the area and are recommending to the Commission to post Santa Fe Avenue from 142 feet of Lemon Street to 358 feet east of Lemon Street "No Parking Anytime" buses exempt Monday through Friday.

Lieutenant Mayes spoke on the red light cameras. Due to the recent things that occurred in San Diego, 9 legal points were addressed. Eight of the points were found to be valid dealing with the rights of privacy. One issue in regards to implementing this process was that the company that they were networking was running the whole program with very little input by the police making decisions on loop placement and how they were going to process them. They had generic stamps as to who was approving these sites. The law says the Police Department shall run the program so they found enough evidence submitted that the Police Department had very little to do with it. The other issue that came up was whether they paid for a citation on a first citation basis whether or not that was a contingency fee. October 25, 2001 a meeting is scheduled with the North Justice Center Judges, all the Police Chiefs of the North Orange County Police Departments. Before the Fullerton Police Department goes forward with this they will be doing a little more evaluation as to what the truth of the matter is regarding red light violations in the City. Fullerton Police Department is enter into a preprogram with our vendor to do some evaluations in intersections and determine whether or not they are red light violations, enforcements warranted at those locations. There may be a statewide audit just to see how agencies are paying for the program and make sure that the Police Department is actively involved in and oversees the programs.
Chairman Ginter stated that the residents have written to the newspapers regarding the cost to the City the economic problem that the citizens will be subsidizing this program. Have the numbers been reviewed? If we sign a contract with Nestor, they are entitled to so much money and if they do not get it, then the City has to underwrite the difference.
Lieutenant Mayes stated that in his estimation there is no cost to the citizens. The Police Department is looking at all the different pricing options available to the City and that is why they want to add the evaluation of the intersection before hand to see how many violations you are looking at, if you could project expected reduction rates, we would know how many violations we were looking at. The Police Department's position isn't for this to be a money maker but to provide safety at the intersections and if we get anything out of this, it would be a much needed second supervisor in the traffic bureau to assist with the number of people that are being managed by one supervisor.
Commissioner Buck asked if he went through an intersection, the camera picked him up, he received a ticket, and chose not to pay it. What would happen?
Lieutenant Mayes stated that at this point it is driver liability for the violation. If it is a match on you then they have access to DMV systems sound x's photographs, the Police Department could identify that is you by picture and you choose not to pay it, the courts in Orange County have already cited that with the proper paperwork submitted, they will issue a warrant for your arrest. The flaw on the system is if there is someone other than the registered owner driving and there is some difficulty in finding a match on who the person is, there is a question on how much time you invest into that to identify the violator of traffic violations.
