APPROVAL OF MINUTES:

INTRODUCTIONS - COMMITTEE AND STAFF MEMBERS:

ACTION ITEMS:

PRJ05-00774 - ZON05-00111. APPLICANT AND PROPERTY OWNER: RICHARD ANDERSON. A request to reduce the side yard setback from five feet to four feet on property located at 790 Carhart Avenue (west side of Carhart Avenue, approximately 566 feet south of Fern Drive) (R-1-10 Zone) (Categorically exempt under Section 15301 of CEQA Guidelines) (JE)

Senior Planner Eastman explained that this request is to reduce the side yard setback within an R-1-10 zone from 5 feet to 4 feet. The project is within the Carhart Avenue Overlay Zone. The applicant is proposing to add an additional bedroom at the back and a bath. This addition as proposed would not be seen from the street. The architecture of the addition is consistent with the architecture of the existing home. The proposal is within the setback requirements of the Municipal Code's allowance for a Minor Site Plan Review application (up to 20% reduction).

Staff did receive a phone call from an adjacent property owner. However, there has been no strong opposition to the proposal. She was not opposed to the project, but was concerned that the addition did not encroach closer to her property.

She said that a number of years ago a survey had been conducted. The survey indicated that the existing house was built on the property line. The assessor's parcel map for the property shows a 53.01 rear yard width and should be the same for the front yard.

Richard Anderson, architect, who was present to discuss the project, said he has not researched the validity of the property line, but his goal is to build the addition without encroaching. As far as justification is concerned, there may be others in the neighborhood that have a similar situation.

Committee Member Tabatabaee said there are constraints if the addition has to be moved to the opposite side of the property. The property line should be verified given the neighbor's concern.

Committee Member Eastman spoke favorably about the proposal. The design seems reasonable; the building is consistent with the character of the neighborhood, and he would feel comfortable approving the project based on a recommendation that the property owner shall submit a survey for the purpose of verifying the location of the southern property line.

MOTION made by Committee Member Tabatabaee, SECONDED by Committee Member Murphy and CARRIED unanimously by all present to APPROVE the project with the following condition. (Resolution No. 436)

1. Prior to the issuance of building permits, the property owner shall submit a survey to the Director of Development Services for the purposes of verifying the location of the southern property line in relation to the existing residence and proposed addition, as per submitted plans. The survey shall be prepared and signed by a state licensed surveyor.
