MINUTES OF THE REGULAR MEETING OF THE FULLERTON PLANNING COMMISSION

COUNCIL CHAMBERS - FULLERTON CITY HALL

WEDNESDAY JULY 22, 1998 7:00 P.M.

CALL TO ORDER:

The meeting was called to order by Vice-Chairman Godfrey at 7:00 p.m.

ROLL CALL:

Vice-Chairman Godfrey; Commissioners Ballard, LeQuire, Munson, Ranii and Simons

ABSENT:

Chairman Sandoval

MINUTES:

MOTION by Commissioner Ranii, seconded and CARRIED unanimously by voting members present, that the Minutes of the July 8, 1998, meeting be APPROVED AS WRITTEN.

PUBLIC HEARINGS

ITEM NO. 1a
AMENDMENT A-1449. APPLICANT: CITY OF FULLERTON.

To consider changing the zone classification from M-P-80,000 to M-P-40,000 on property located at 1645 East Orangethorpe Avenue and 1141 South Acacia Avenue (northwest corner of Orangethorpe and Acacia Avenues) (M-P-80,000 zone) (Negative Declaration) (Continued from June 24 and July 8, 1998.)

ITEM NO. 1b
PARCEL MAP PM-98-150. APPLICANT AND PROPERTY OWNER: L. J. VACCHER.

To consider plans to subdivide into two lots the property located at 1645 East Orangethorpe Avenue and 1141 South Acacia Avenue (northwest corner of Orangethorpe and Acacia Avenues) (M-P-80,000 zone) (Categorically exempt under Class 1 of CEQA Guidelines) (Continued from June 24 and July 8, 1998).

Chief Planner Rosen reported that the applicant had again requested a continuance for items 1a and 1b. MOTION by Commissioner Ballard, seconded, and CARRIED unanimously by voting members present, that said item be CONTINUED to the next regularly-scheduled meeting of August 12, 1998.

ITEM NO. 2
AMENDMENT A-1451 AND GENERAL PLAN REVISION GPR-98-2. APPLICANT: CITY OF FULLERTON

Staff report dated July 16, 1998, was presented pertaining to a request to consider changing the land use designation from "Medium-Density Residential" to "Low-Medium Density Residential" on the Land Use Map of the General Plan and changing the zone classification from R-3 to R-2P for property located at 201-205 West Whiting Avenue. A vicinity sketch was displayed.

Program Planner Linnell reported that this item was initiated by the City with the approval of the property owner. The request for the change in zone classification will accommodate the property owner's desire to construct two single-family homes on the site. The present R-3 zone designation has development standards which do not allow the construction of these homes, and the R-2 zone is more consistent with the neighborhood. The property owners in the area petitioned the City in 1996 to change the zone to R-2P, so they are in favor of the request. Staff reminded the Commission that they would be voting on the zone change only, and not the development project itself.

Vice-Chairman Godfrey questioned whether staff anticipated any problems with the utilities or sewer lines. Program Planner Linnell answered that the public infrastructure for the property is sound and the applicant has already researched these items with the City.

Commissioner Munson asked if the applicant was aware and understood that the property would receive a "P" designation. Program Planner Linnell replied that he had numerous discussions with the applicant concerning this matter. In addition, the applicant had already appeared before the Redevelopment Design Review Committee with his plans for the proposed project.

Commissioner Ballard asked if there would be access to the property off of Chapman Avenue, and Program Planner Linnell stated that although there would be frontage on Chapman Avenue, there would be no access from that street.

Public hearing opened.

Garrett Hartney, 402 North Highland Avenue, reiterated neighborhood support of the zone change, and the proposed project. He presented a petition signed by residents in the area in support of the R-2P zone for the property.

Nicholas Perez, 211 West Whiting Avenue, also supported staff's recommendation.

There was a consensus of the Commission for approval. MOTION by Commissioner Ballard, seconded and CARRIED unanimously by voting members present, that the Negative Declaration be CERTIFIED. The reading of the title of Resolution No. 6794 RECOMMENDING that the City Council change the land use designation from "Medium-Density Residential" to "Low-Medium Density Residential" on the land use map of the General Plan and change the zone classification from R-3 to R-2P for property located at 201-205 West Whiting Avenue, was waived. MOTION by Commissioner Ballard, seconded and CARRIED unanimously by voting members present, that said Resolution be APPROVED AS WRITTEN.

Chief Planner Rosen reported that this item would be heard by the City Council on August 18, 1998.

ITEM NO. 3
AMENDMENT A-1450. APPLICANT: CITY OF FULLERTON.

Staff report dated July 15, 1998, was presented pertaining to a request to consider amending Chapter 15.30 (Commercial Zone Classifications) of the Fullerton Municipal Code pertaining to Conditional Use Permit review procedures for a "car rental agency" use.

Program Planner Linnell reported that this amendment was initiated at Commission request, to allow car rental agency uses outright in any commercial zone.

Commissioner Ballard felt that the ordinance should be amended to read that no sales of such vehicles shall be allowed on site. The remaining Commissioners concurred with said revision to the Ordinance.

Public hearing opened, but there was no one present who wished to speak on this matter. Public hearing closed.

There was a consensus of the Commission for approval. MOTION by Commissioner Ballard, seconded and CARRIED unanimously by voting members present, that the Negative Declaration be CERTIFIED. The reading of the title of Resolution No. 6795 RECOMMENDING that the City Council amend Chapters 15.04 and 15.30 of the Fullerton Municipal Code pertaining to Conditional Use Permit review procedures for car rental agencies, was waived. MOTION by Commissioner Ballard, seconded and CARRIED unanimously by voting members present, that said Resolution be ADOPTED AS WRITTEN.

ITEM NO. 4
ZONING CODE WORKSHOP #1

The first of several workshops scheduled over the next year to consider possible reorganization, reformatting, and amendments to the City's Zoning Code. The overall objective is to make the code easier to use. This item will cover possible revisions to the Residential Chapter of the Zoning Code. Formal adoption hearings for the Residential Chapter are tentatively scheduled for April 1999.

MOTION by Commissioner Ballard, seconded and CARRIED unanimously by voting members present, that this matter be CONTINUED to the next regularly-scheduled meeting of August 12, 1998, at 4:00 p.m.

REVIEW OF COUNCIL ACTIONS

Chief Planner Rosen gave a brief report on recent City Council meetings.

ITEM B
PUBLIC COMMENTS

Mr. Kenneth Mack, 712 South Courtney Avenue, had comments regarding the Environmental Impact Report for the proposed Con Agra flour mill. He felt that the document was "shaded" in support of staff's recommendation. He also expressed disappointment over the limited number of citizens who had been notified of the Planning Commission hearing of this matter. Vice-Chairman Godfrey explained the notification process of the City, and the expanded mailing area for this project. Commissioner Munson also gave a brief explanation of the Planning Commission purview.

Chief Planner Rosen added that staff would be more than willing to meet with Mr. Mack to further discuss the Negative Declaration.

The next regularly-scheduled meeting will be August 12, 1998, at 4:00 p.m. and 7:00 p.m.

There being no further business, the meeting was adjourned at 7:35 p.m.
