PLANNING COMMISSION MEETING AGENDA

SEPTEMBER 24, 1997

Persons addressing the Planning Commission shall be limited to 10 minutes unless an extension of time is granted by the Chairman, subject to approval of the Planning Commission. When any group of persons wishes to address the Commission, it shall be proper for the Chairman to request that a spokesman be chosen to represent the group.

Public comment will be allowed on agenda items at the time the item is considered.

Public comment will be allowed on matters not appearing on the agenda but within the Planning Commission's jurisdiction, at the end of the agenda. No action may be taken on off-agenda items except as provided by law.

The Planning Commission's approval or denial of any action on this agenda shall become final and effective ten days after its decision unless an appeal is made in writing within this ten-day period to the City Council by either an applicant or an opponent. The filing of an appeal within such time limit shall stay the effective date of the order of the Planning Commission until such time as the City Council has acted on the appeal. Anyone interested in making an appeal should contact the Development Services Department for assistance.

1. (a) APPEAL OF A NOTICE AND ORDER OF THE BUILDING OFFICIAL TO VACATE BUILDING. An appeal hearing to determine whether an existing law school should be vacated for violations of the Uniform Building Code on property located at 233 East Commonwealth Avenue (Pacific West College of Law) (northwest corner of Commonwealth Avenue and Lemon Street). -Uphold the Notice and Order to Vacate
1. (b) CONDITIONAL USE PERMIT CUP-955/STATUS UPDATE. An update on the progress of compliance with conditions of approval attached to Conditional Use Permit CUP-955 and work required to be completed under the Notice and Order of the Building Official on property located at 233 East Commonwealth Avenue (Pacific West College of Law) (northwest corner of Commonwealth Avenue and Lemon Street). -Set public hearing for revocation of the CUP

2. CONDITIONAL USE PERMIT CUP-704. PROPERTY OWNER: JAMES ACCORNERO. To consider revocation of an existing Conditional Use Permit for a fraternity use at 2132 Associated Road due to the abandonment of the property by Lambda Chi Alpha Fraternity. -Revoke Conditional Use Permit
3. CONDITIONAL USE PERMIT CUP-705. PROPERTY OWNER: JOSEPH ROBERT REDL. To consider revocation of an existing Conditional Use Permit for a fraternity use at 2108 Teri Place due to the abandonment of the property by Delta Sigma Phi Fraternity. -Revoke Conditional Use Permit
4. CONSIDERATION OF FILING A CIVIL CODE COMPLAINT TO DECLARE EXISTENCE OF A PUBLIC NUISANCE. To provide input to staff on the consideration of filing a civil code complaint to declare the existence of a public nuisance at 2100 Teri Place due to repeated police activity and failure to comply with the provisions of the Fullerton Municipal Code relating to fraternity uses. -Provide comments

C. AGENDA FORECAST. The next meeting of the Planning Commission will be October 22, 1997, at 7:00 p.m. The October 8, 1997, meeting has been canceled.

  • To review the operation of a reception hall/community social service facility located at 1441 North Brea Boulevard.
  • To determine whether to file notices of violation of the State Subdivision Map and Title 16 of the Fullerton Municipal Code in conjunction with the apparent subdivision and sale of property at 1645 East Orangethorpe Avenue and 1141 South Acacia Avenue.
  • Acting as the Landmarks Commission, to consider the request and recommendation of Fullerton Heritage to update the 1977 Historical Building Survey and adopted list of Significant Properties.
